In New York they are trying a hero for the death of a mentally ill person on a Subway who waa menacing and threatening to attack women and small children on the train and said "I don't care of they give me life in prison". A brave marine waited and as the crazy man became more belligerent and stepped toward a woman with a baby carriage. Daniel Penny got hold of the man who resisted and they ended up on the floor with 911 called and others helping to try to control the threatening struggling crazy man. Penny talked to police and told the story above. The police seemed satisfied.

If there was a physically fit marine who could have taken the guy down before he killed these people, they now would be hesitant to act knowing that they would be on trial as is Penny.
