Question for the lawyers out there....

My wife was in an accident here in Florida and was given a ticket for using the center lane when another car pulled out from a side street and hit her. She was moving to clear the thru traffic and make a left hand turn at the next light. Florida law 316.089 seems to say she has the right to travel in the lane if empty (which it was) and if making a left hand turn. Not to mention the other car should have checked to see if oncoming traffic was clear before pulling out. Should we fight this? Do we need an attorney? Don't really have the funds to afford a lawyer and the insurance company is telling us this is a bogus ticket so it wont raise rates..

I could really use legit thoughts or advice.
