So was it a DUI for Aldon or not?

Saw a video snip of Aldon on the local news a little while ago and he said that it was not a DUI but he wanted to apologize to everyone for what really did happen...why is he saying this?....unless he refused to take a breathalizer test and doesn't consider it a DUI because of that how does he not think it was a DUI?
