Man shoots intruder and goes back to bed
Now charged with murder. Dude obviously needed more range time. Sure he hit the guy in the back of the neck as he ran away in the dark. But he missed the shot when the guy was coming at him with a pick axe and was a lot closer. That could be an expensive miss.
Shooting an unarmed man in the back is not something that's going to get you an acquittal most places. Of course, this is Texas...
